MINUTES of the Board meeting of December 14, 2005 to be approved.

HEARING

1. The purpose of this hearing, Ordinance No. 2005-12-02, is for a Michael Phelps and Ronald Rodriguez plan amendment request. On November 17, 2005, the Planning Commission approved the Phelps and Rodriguez request for a Plan Map Amendment and Reasons Exception to expand the Melrose Rural Community Boundary and allow a cluster subdivision on a 22.4 acre parcel located south of Melrose Road, at the end of Heather Lane, and adjacent to the Melrose rural community boundary. Because the application involves an exception, the Board must now hold a hearing on the record and either affirm, reverse or modify the Planning Commissionís decision. Planning Department File No. 05-244. None of the parties have appealed the Planning Commissionís decision.

2. The purpose of this hearing, Ordinance No. 2005-12-03, is for a Kurt and Tammy Johnson plan amendment request. On November 17, 2005, the Planning Commission approved the Johnson request for a Plan Amendment from Agriculture to Industrial, a Zone Change from FG to ME (Rural Industrial), along with a Reasons Exception to Goal 3 to allow a heavy equipment maintenance and repair facility on a 7.7 acre portion of a 10.55 acre parcel located off Boyer Road north of Riddle. Because the application involves a resource land and an exception, the Board must now hold a hearing on the record and either affirm, reverse or modify the Planning Commission decision. Planning Department File No. 05-242. None of the parties have appealed the Planning Commissionís decision.

FAIR

1. Order recommending reappointment of members, Bob Vangstad and David Briggs,
to the Douglas County Fair Board extending their terms to December 31, 2008.

2. Order accepting completion of contract with Meili Construction in the matter of the contract for construction of the Fairgroundís Conference Hall Facility, Douglas County, Oregon. Total amount of contract at completion is $3,547,870.17.

PLANNING

1. Order, Planning Department File No. 05-243, affirming the decision of the Planning Commission in the Roseburg Forest Products quasi-judicial amendment to the Douglas County Comprehensive Plan.

2. Approval of Findings of Fact for B & K Natural Farm affirming the Planning Commissionís decision and granting approval of a request for Conditional Use Permit to allow a poultry processing facility at Nonpareil. Planning Department File No. 05-155. On December 14, 2005, the Board deliberated, affirming and modifying the Planning Commissionís decision on the matter.

3. Order accepting irrevocable offer to sell property with waiver of objection to assessment. The property owner is Ron Langdon. Planning Department File No. 05-264. Acceptance of this offer to sell and waiver will facilitate improvement of North Bank Road to County Road standards.

4. Order Setting Hearing Date and Notice of a Public Hearing for annexation of property to the Riddle Rural Fire District, Chief Petitioner: Dawson. The petition has qualified under ORS 198.855(3), having the signatures of 100% of the property owners of the single parcel of land proposed to be annexed. The proposed annexation is in compliance with the Douglas County Comprehensive Plan; and, therefore, is in compliance with the Statewide Planning Goals. There are no known objectors at this time.

5. Order Setting Hearing Date and Notice of a Public Hearing for annexation of property to the Oakland Rural Fire District. (Chief Petitioner: Banducci) The petition has qualified under ORS 198.857, having the signatures of 100% of the property owners of the single parcel of land proposed to be annexed. The proposed annexation is in compliance with the Douglas County Comprehensive Plan; and, therefore, is in compliance with the Statewide Planning Goals. There are no known objectors at this time.

6. Order Setting Hearing Date and Notice of a Public Hearing for annexation of property to the Lookingglass Rural Fire District. (Chief Petitioner: Haggenmiller Smith) The petition has qualified under ORS 198.755(2)(a)(b), a petition for annexation shall be signed by not less than: (a) fifteen percent of the electors or 100 electors, whichever is the lesser, registered in the area proposed to be annexed; or (b) fifteen owners of land or the owners of 10 percent of the acreage, whichever is the greater number of signers, within the area proposed to be annexed. The proposed annexation is in compliance with the Douglas County Comprehensive Plan; and, therefore, is in compliance with the Statewide Planning Goals. There are no known objectors at this time. The hearing date can be set for January 25, 2006.

PUBLIC WORKS

1. Order awarding bid for Project No. 10749-003 for the purchase of steel superstructure for Scott Henry Bridge Replacement. Project was opened on December 4, 2005. Four bids were received. Fought and Company, Inc. was the lowest responsive bid. Total purchase: $561,640.

2. Order accepting warranty deed from Kenneth H. and Dorothy F. Hutton for the acquisition of right-or-way to be used for the widening and realignment of Old Pacific Highway County Road No. 386. Consideration is $2,500, plus escrow fees.

MISCELLANEOUS

1. Order recommending reappointments of members Gerald Briggs, Milton Bartholomew, Rex Fuller, and Robert Hall to the Douglas County Weed Advisory Board extending their terms to December 31, 2008.

2. Order recommending the appointment of a Glendale Justice of the Peace Pro Tempore, Carol Roberts, during a temporary absence or other incapacity of the Glendale District Justice of the Peace, Candace Hissong, for the time period of January 1, 2006 through December 31, 2006.

3. Order recommending the appointment of a South Douglas (Canyonville) Justice of the Peace Pro Tempore, Candace Hissong, during a temporary absence or other incapacity of the South Douglas District Justice of the Peace, Carol Roberts, for the time period of January 1, 2006 through December 31, 2006.

4. Closing out Regional Housing Center CDBG Grant # HC3003. Ms. Brenda Lewis will have a brief power point presentation.

5. Don Cherry, from Human Resources, will have an update on the results of the Douglas County Food Drive.

6. Transportation update: Peggy Kennerly from Health and Social Services; and, Chris Patoine, Umpqua Transit.
