MINUTES of the Board meeting held on September 16, 2009

CITIZEN PARTICIPATION FOR COMMENTS ON AGENDA ITEMS ONLY

1. BID OPENING – For (1) Used 4 Wheel Drive Backhoe
Bid opening #975 for (1) Used 4 wheel drive backhoe. Previous bids were rejected and the bid was re-advertised.

2. HEARING – For Annexation of property and Order Incorporating Territory to the Oakland Fire District
The “Notice of a Public Hearing” and “Order Setting a Hearing Date” was signed on August 26, 2009, for the petition of annexation by Chief Petitioner: GILL, to have property annexed into the Oakland Rural Fire District. The petition has qualified under ORS 198.855(3), and annexation petition is signed by all of the owners of all land in the territory proposed to be annexed. The signatures of the property owners of the proposed annexation have been verified. There are no known objectors at this time. This will be the only hearing for annexation of this property to the Oakland Rural Fire District and the Order Incorporating Territory.

3. HEARING – Victor and Susan Willams Request for Expansion of the Myrtle Creek Urban Growth Boundary
Victor and Susan Williams: On August 20, 2009, the Planning Commission approved the Williams request to expand the Myrtle Creek Urban Growth Boundary (UGB), to include a .70 acre portion of their 7.4 acre ownership, with a Plan Amendment from Agriculture and Limited Commercial to Low Density Residential and Zone Change from Farm Cropland & Community Commercial to Suburban Residential. The amendment will allow the applicants to establish one single family dwelling on the west side of North Old Pacific Highway in the Tri-City Urban Unincorporated area. Planning Dept. File No. 009-026

4. ASSESSOR – Tax Refund
Order refunding taxes to Millard and Lavone Manning in the amount of $322.91.

5. COMMISSION ON CHILDREN AND FAMILIES – Contract with Family Development Center – Relief Nursery
The contract between Douglas County and the Family Development Center is for the continuing operation of the Relief Nursery. The contract has a maximum amount payable of $220,346 and a contract period from October 1, 2009 through June 30, 2010. Funds for this contract are State general funds administered by the Oregon Commission on Children and Families.

6. COMMISSION ON CHILDREN AND FAMILIES – Contract with Family Development Center – Healthy Start
The contract between Douglas County and the Family Development Center is for the continuing operation of Healthy Start Intensive Services. The contract has a maximum amount payable of $154,218 and a contract period from October 1, 2009 through June 30, 2010. Funds for this contract are State general funds administered by the Oregon Commission on Children and Families.

7. COMMISSION ON CHILDREN AND FAMILIES -- Contract with CASA of Douglas County
The contract between Douglas County and CASA of Douglas County is for the continuing operation of the CASA Program. The contract has a maximum amount payable of $32,022 and a contract period from October 1, 2009 through June 30, 2010. Funds for this contract are State general funds administered by the Oregon Commission on Children and Families.


8. COMMISSION ON CHILDREN AND FAMILIES – Contract with Phoenix School of Roseburg
The contract between Douglas County and Phoenix School of Roseburg is for the continuing operation of the Teen Drop-In Center. The contract has a maximum amount payable of $16,598 and a contract period from July 1, 2009 through December 31, 2009. Funds for this contract are State general funds administered by the Oregon Commission on Children and Families.

9. COMMISSION ON CHILDREN AND FAMILIES – Contract with Mercy Medical Center
The contract between Douglas County and Mercy Medical Center is for the continuing operation of the Welcome Baby program. The contract has a maximum amount payable of $20,000 and a contract period from October 1, 2009 through June 30, 2010. Funds for this contract are State general funds administered by the Oregon Commission on Children and Families.

10. COMMISSION ON CHILDREN AND FAMILIES – Initial Budget Distribution for the 2009-2011 Biennium
Each biennium, a budget distribution document is required by the Oregon Commission on Children and Families to release funds to Douglas County pursuant to ORS 417.775(5), (7), (14) and OAR 423-010-0027. The Initial Budget Distribution for 2009-2011 was approved by the Douglas County Commission on Children and Families on July 28, 2009.

11. COMMUNICATIONS – Agreement with US Cellular
Agreement with US Cellular on the County’s Cinnamon Butte radio site. US Cellular is adding a room to our building at a cost of $9,800.00. US Cellular is also adding a 25 foot extension to the tower at no cost to the County.

12. HEALTH AND SOCIAL SERVICES – Contract with Douglas County Residential Training Facilities
Contract with Douglas Residential Training Facilities, Inc. Pass through STF funding to provide transportation services to seniors and people with disabilities. Total maximum reimbursable cost is $168,491.00 (Operational costs $41,470.00/Four replacement vehicles $78,962.00/Preventative maintenance $48,059.00).

13. HEALTH AND SOCIAL SERVICES – Contract with Sunrise Enterprises
Contract with Sunrise Enterprises. Pass through STF funding to provide transportation services to seniors and people with disabilities. Maximum reimbursable cost for operation is $40,000.00.

14. HEALTH AND SOCIAL SERVICES – Contract with Seniors Escorting Seniors
Contract with Seniors Escorting Seniors. Pass through STF funding to provide transportation services to seniors and people with disabilities. Total maximum reimbursable cost is $15,939.00 (operational costs $11,540.00/preventative maintenance $4,399.00)

15. HEALTH AND SOCIAL SERVICES – Contract with Mercy Medical Center, Inc.
Contract with Mercy Medical Center, Inc. Pass through STF funding to provide transportation services to seniors and people with disabilities. Total maximum reimbursable cost is $75,278.00 (operational costs $67,792.00/preventative maintenance $7,486.00).

16. PARKS AND FACILITIES – Contract Extension and Modification with Umpqua Sheet Metal
Contract extension and modification with Umpqua Sheet Metal to provide HVAC Repair and Sheet Metal services as needed. This extends the contract to August 31, 2010 and increases the amount of the contract from $25,000.00 to not to exceed $50,000.00.

17. PARKS AND FACILITIES – Extension of Agreement with Winchester Bay Rural Fire Protection District
The Park’s Division is requesting an extension of the agreement with Winchester Bay Rural Fire Protection District to June 30, 2014. This agreement is to provide fire protection services in Winchester Bay. Yearly fees are approximately $2,500 per year split between Parks and The Museum Lighthouse.

18. PUBLIC WORKS – Order Accepting Warranty Deed for the Acquisition of Real Property
Order accepting warranty deed for the acquisition of real property for Harrison Estates Subdivision from the Cow Creek Band of the Umpqua Tribe of Indians.

19. PUBLIC WORKS – Cooperative Improvement Agreement with Oregon Department of Transportation and the City of Roseburg
Cooperative improvement agreement with Oregon Department of Transportation and City of Roseburg for I-5/Edenbower Boulevard interchange and I-5/Del Rio Road interchange improvements.

20. PUBLIC WORKS – Second Amendment of Contract with Donald E. Bowes, P.E.
Second amendment of Contract with Donald E. Bowes, P.E. to extend term for FERC Potential Failure Modes Analysis and report, and FERC Part 12D Independent Consultant Inspection and report for Galesville Dam to December 31, 2010 due to delay in completion of services.

21. PUBLIC WORKS – Order Accepting Completion of Contract
Order accepting completion of contract for the overlay of Cherokee Avenue #334A, mile post 0.00 to 0.35. The contract has been completed and all requirements have been met. Egge Sand & Gravel in the amount of $92,795.33.

22. PUBLIC WORKS – Order Accepting Completion of Contract
Order accepting completion of contract for the overlay of North Stephens Road #388, Strauss Avenue #901A and Aster Street #335K. The contract has been completed and all requirements have been met. Egge Sand and Gravel in the amount of $255,304.41.

23. SHERIFF – Department of Justice Fiscal Year 2009 Byrne Memorial Justice Assistance Grant
Grant for purchase of seven Bushmaster M4A3 carbine rifles that will be mounted in patrol vehicles and six Taser X26 electronic control devices for patrol deputies. It is the Douglas County Sheriff’s Office goal to put a Taser on every deputy’s duty belt as a less-lethal option and equip each patrol vehicle with a shoulder weapon for stand-off capability. With the vast area of patrol responsibility and the lack of adequate patrol force to patrol it, the department feels these purchases are necessary to give their deputies more options in lethal and stand-off situations.

24. MISCELLANEOUS – Deliberation and Appointments to the Board of Property Tax Appeals (BOPTA)
Recruitment for BOPTA was advertised with Douglas County media. Nine applications were received and all are recommended for appointment.

25. MISCELLANEOUS – Order Delegating Authority to Shirley Counts to Act as the Douglas County Authorized Representative for MMSEA
Order delegating authority to Shirley Counts to act as the Douglas County authorized representative to perform the duties of the county’s authorized representative for purposes of the Medicare Secondary Payer Mandatory Reporting Provisions in Section 111 of the Medicare, Medicaid and SCHIP Extension Act (MMSEA) of 2007, including the authority to sign and submit the attached Safeguarding & Limiting Access to Exchanged Data from.

28. ADJOURNMENT AND NEXT MEETING
The next regularly scheduled Board meeting will be held October 7, 2009 at 9:00 a.m. in Room 216 of the Douglas County Courthouse, Roseburg, OR.
